AN ACT
1 Amending the act of December 19, 1988 (P.L.1262, No.156),
2 entitled "An act providing for the licensing of eligible
3 organizations to conduct games of chance, for the licensing
4 of persons to distribute games of chance, for the
5 registration of manufacturers of games of chance, and for
6 suspensions and revocations of licenses and permits;
7 requiring records; providing for local referendum by
8 electorate; and prescribing penalties," in games of chance,
9 providing for payment and for online raffle sales; and
10 abrogating a regulation.
11 The General Assembly of the Commonwealth of Pennsylvania
12 hereby enacts as follows:
13 Section 1. The act of December 19, 1988 (P.L.1262, No.156),
14 known as the Local Option Small Games of Chance Act, is amended
15 by adding sections to read:
16 Section 301.2. Payment.
17 (a) Methods.--
18 (1) Except as provided under paragraph (2), a licensed
19 eligible organization may accept payment via credit card,
20 debit card, mobile payment services or other electronic
21 payment method for the playing of games of chance.
1 (2) A licensee under Chapter 9 may not accept mobile
2 payment services for the playing of games of chance.
3 (b) Definitions.--As used in this section, the following
4 words and phrases shall have the meanings given to them in this
5 subsection unless the context clearly indicates otherwise:
6 "Mobile payment service." A service in which a money payment
7 is made electronically through a money transfer service, such as
8 Venmo, Paypal, Cash App or an equivalent money transfer service.
9 Section 303.2. Online raffle sales.
10 (a) Operations.--A licensed eligible organization may
11 conduct and reveal the winner of raffles through a publicly
12 accessible Internet website, social media platform or mobile
13 application.
14 (b) Payments.--A licensed eligible organization may accept
15 electronic payment via credit card, debit card, mobile
16 electronic payment application or other electronic payment
17 method for the purchase of a raffle ticket, if all of the
18 following apply:
19 (1) The organization employs a method to detect the
20 physical location of an individual who buys a ticket for the
21 raffle, but the organization may not accept payment from an
22 individual who is located outside of this Commonwealth.
23 (2) The organization employs a method to verify that the
24 individual who buys a raffle ticket is at least 18 years of
25 age, but the organization may not accept payment from an
26 individual under 18 years of age.
27 (3) The organization does not violate the provisions of
28 31 U.S.C. Subt. IV Ch. 53 Subch. IV (relating to prohibition
29 on funding of unlawful Internet gambling).
30 (c) Applicability.--The following sections shall not apply

1 to online raffle sales:
2 (1) Section 302.
3 (2) Section 303(b).
4 (3) Section 907.
5 Section 2. The provisions of 61 Pa. Code § 901.506 are
6 abrogated insofar as they are inconsistent with the addition of
7 section 301.2 of the act.
8 Section 3. This act shall take effect in 60 days.
