                                    AN ACT
 1   Amending the act of May 1, 1933 (P.L.103, No.69), entitled "An
 2      act concerning townships of the second class; and amending,
 3      revising, consolidating and changing the law relating
 4      thereto," in contracts, further providing for letting
 5      contracts.
 6      The General Assembly of the Commonwealth of Pennsylvania
 7   hereby enacts as follows:
 8      Section 1.    Section 3102(g) of the act of May 1, 1933
 9   (P.L.103, No.69), known as The Second Class Township Code, is
10   amended to read:
11      Section 3102.    Letting Contracts.--* * *
12      (g)   Unless covered under the bonding requirements of the act
13   of December 20, 1967 (P.L.869, No.385), known as the "Public
14   Works Contractors' Bond Law of 1967," the successful bidder
15   shall furnish a bond, or irrevocable letter of credit or other
16   security with suitable reasonable requirements acceptable to the
17   board of supervisors, guaranteeing performance of the contract,
18   in an amount as determined by the supervisors at the time of
19   advertising for bids which shall be not less than ten percent
 1   nor more than one hundred percent of the amount of the contract,
 2   within twenty days after the contract is awarded. If the bidder
 3   fails to furnish the bond or irrevocable letter of credit or
 4   other security within twenty days, unless delivery is made or
 5   the entire contract is fulfilled during that time, the contract
 6   is void. Delivery, accomplishment and guarantees may be required
 7   in all cases, including the exceptions contained in this
 8   section.

10      Section 2.   This act shall take effect in 60 days.
