AN ACT
1 Amending the act of December 17, 1968 (P.L.1224, No.387),
2 entitled "An act prohibiting unfair methods of competition
3 and unfair or deceptive acts or practices in the conduct of
4 any trade or commerce, giving the Attorney General and
5 District Attorneys certain powers and duties and providing
6 penalties," further providing for definitions.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 2(4) of the act of December 17, 1968
10 (P.L.1224, No.387), known as the Unfair Trade Practices and
11 Consumer Protection Law, is amended by adding a subclause to
12 read:
13 Section 2. Definitions.--As used in this act.

15 (4) "Unfair methods of competition" and "unfair or deceptive
16 acts or practices" mean any one or more of the following:

18 (xx.1) Refusing to accept cash payment for the retail sale
19 of goods or services having a sale price of less than five
20 hundred dollars ($500) when the purchaser is physically present
1 at the point of sale. This subclause does not apply to the
2 retail sale of goods or services where the seller has a written
3 policy that currency in excess of a certain denomination will
4 not be accepted as payment and has posted the policy
5 conspicuously for purchasers to view prior to the point of sale
6 and the purchaser tenders cash payment in a denomination that
7 exceeds the amount specified in the policy.

9 Section 2. This act shall take effect in 60 days.
