AN ACT
1 Amending the act of May 1, 1984 (P.L.206, No.43), entitled "An
2 act providing for safe drinking water; imposing powers and
3 duties on the Department of Environmental Resources in
4 relation thereto; and appropriating certain funds," further
5 providing for definitions; and providing for prohibition of
6 water fluoridation.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 3 of the act of May 1, 1984 (P.L.206,
10 No.43), known as the Pennsylvania Safe Drinking Water Act, is
11 amended by adding a definition to read:
12 Section 3. Definitions.
13 The following words and phrases when used in this act shall
14 have the meanings given to them in this section unless the
15 context clearly indicates otherwise:

17 "Fluoride-containing chemicals." A chemical or compound
18 containing fluoride and used with the intent of raising the
19 fluoride levels of water, including sodium fluoride,
20 fluorosilicic acid and sodium fluorosilicate.

2 Section 2. The act is amended by adding a section to read:
3 Section 12.1. Prohibition of water fluoridation.
4 It shall be a violation of this act for any supplier of water
5 to add fluoride-containing chemicals to water provided by a
6 public water system that the supplier of water owns or operates.
7 Section 3. This act shall take effect in 60 days.
