                                         AN ACT
 1   Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
 2      Statutes, in registration of vehicles, further providing for
 3      vehicles exempt from registration; in fees, further providing
 4      for farm vehicles; and, in inspection of vehicles, further
 5      providing for requirement for periodic inspection of vehicles
 6      and for operation of vehicle without official certificate of
 7      inspection.
 8      The General Assembly of the Commonwealth of Pennsylvania
 9   hereby enacts as follows:
10      Section 1.       Section 1302(10) of Title 75 of the Pennsylvania
11   Consolidated Statutes is amended by adding subparagraphs to
12   read:
13   § 1302.    Vehicles exempt from registration.
14      The following types of vehicles are exempt from registration:
15             * * *
16             (10)    Any farm vehicle used exclusively upon a farm or
17      farms owned or operated by the owner of the vehicle, subject
18      to the following:

20                    (i.5)   Type AA--Such a farm vehicle with a gross
 1        vehicle weight rating not exceeding 10,000 pounds and
 2        which displays a currently valid certificate of
 3        inspection may be driven without any restriction as to
 4        time but may only be driven on highways between:
 5                  (A)   Parts of one such farm.
 6                  (B)   Such farms located not more than 50 miles
 7             apart.
 8                  (C)   Such farm or farms and a place of business
 9             located within a radius of 50 miles from such farm or
10             farms for the purpose of buying or selling
11             agricultural commodities or supplies.
12                  (D)   Such farm or farms and a place of business
13             located within a radius of 50 miles from such farm or
14             farms for the purpose of repairing or servicing of
15             the farm vehicle or the trailer or semitrailer being
16             towed or hauled by the farm vehicle.
17             (i.6)    Type BB--Such a farm vehicle with a gross
18        vehicle weight rating of greater than 10,000 pounds and
19        not exceeding 17,000 pounds and which displays a
20        currently valid certificate of inspection may be driven
21        without any restriction as to time but may only be driven
22        on highways between:
23                  (A)   Parts of one such farm.
24                  (B)   Such farms located not more than 25 miles
25             apart.
26                  (C)   Such farm or farms and a place of business
27             located within a radius of 25 miles from such farm or
28             farms for the purpose of buying or selling
29             agricultural commodities or supplies.
30                  (D)   Such farm or farms and a place of business

 1                 located within a radius of 50 miles from such farm or
 2                 farms for the purpose of repairing or servicing of
 3                 the farm vehicle or the trailer or semitrailer being
 4                 towed or hauled by the farm vehicle.
 5                 (i.7)    Type CC--Such a farm vehicle which does
 6             qualify as a motor carrier vehicle and displays a
 7             currently valid certificate of inspection may be driven
 8             without any restriction as to time but may only be driven
 9             on highways between:
10                     (A)    Parts of one such farm.
11                     (B)    Such farms located not more than ten miles
12                 apart.
13                     (C)    Such farm or farms and a place of business
14                 located within a radius of ten miles from such farm
15                 or farms for the purpose of buying or selling
16                 agricultural commodities or supplies.
17                     (D)    Such farm or farms and a place of business
18                 located within a radius of 25 miles from such farm or
19                 farms for the purpose of buying or selling
20                 agricultural commodities or supplies.

22      Section 2.     Sections 1924(b), 4702(a) and 4703(a) of Title 75
23   are amended to read:
24   § 1924.    Farm vehicles.

26      (b)    Certificate of exemption.--The biennial processing fee
27   for a certificate of exemption issued in lieu of registration of
28   a farm vehicle shall be determined by the type of certificate
29   issued and the gross weight or combination weight or weight
30   rating according to the following table:

11   § 4702.    Requirement for periodic inspection of vehicles.
12      (a)    Annual safety inspection.--Except as provided in
13   subsection (b), the department shall establish a system of
14   annual safety inspection of vehicles, including emergency
15   vehicles, farm vehicles [with a gross weight or gross vehicle
16   weight rating of greater than 17,000 pounds] for which a Type D,
17   Type AA, Type BB or Type CC biennial certificate of exemption
18   has been issued and private noncommercial vehicles used to
19   transport students.

21   § 4703.    Operation of vehicle without official certificate of
22                inspection.
23      (a)    General rule.--Except as otherwise provided in this
24   section, no motor vehicle required to bear current registration
25   plates issued by this Commonwealth and no farm vehicle [with a
26   gross weight or gross vehicle weight rating of greater than
27   17,000 pounds] for which a Type D, Type AA, Type BB or Type CC
28   biennial certificate of exemption has been issued shall be
29   driven and no trailer required to bear current registration
30   plates issued by this Commonwealth shall be moved on a highway

1   and no mass transit vehicle shall be operated unless the vehicle
2   displays a currently valid certificate of inspection issued
3   under this chapter.

5      Section 3.   This act shall take effect in 60 days.
