                                      AN ACT
 1   Amending Title 74 (Transportation) of the Pennsylvania
 2      Consolidated Statutes, in turnpike, further providing for
 3      electronic toll collection.
 4      The General Assembly of the Commonwealth of Pennsylvania
 5   hereby enacts as follows:
 6      Section 1.      Section 8117(b)(3) of Title 74 of the
 7   Pennsylvania Consolidated Statutes is amended to read:
 8   § 8117.    Electronic toll collection.
 9      * * *
10      (b)    Imposition of liability.--Liability under this section
11   shall be imposed upon an owner for failure to pay the prescribed
12   toll charges assessed under this section or the regulations of
13   the commission occurring within the territorial limits of this
14   Commonwealth. Based on evidence obtained by a toll collection
15   system, the following shall apply:

17             (3)   An owner that is a lessor of a vehicle as to which
18      an invoice was issued under paragraph (1) shall not be liable
 1    for tolls assessed in the invoice if the owner sends to the
 2    commission a copy of the rental, lease or other contract
 3    document covering the vehicle on the date of travel, with the
 4    name and address of the lessee clearly legible to the
 5    commission, within [30] 60 days after receiving the original
 6    invoice. Failure to send the information within the time
 7    limit under this paragraph shall render the lessor liable for
 8    the tolls and fees assessed in the invoice as prescribed by
 9    this section. If the lessor complies with the provisions of
10    this section, the lessee of the vehicle on the date of travel
11    shall be deemed to be the owner of the vehicle for purposes
12    of this section and shall be subject to liability for the
13    tolls and fees assessed in the invoice under this section.

15    Section 2.    This act shall take effect in 60 days.
