AN ACT
1 Providing for contract requirements and procurement guidelines
2 relating to Federal grant awards.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Short title.
6 This act shall be known and may be cited as the Federal Grant
7 Requirements Act.
8 Section 2. Definitions.
9 The following words and phrases when used in this act shall
10 have the meanings given to them in this section unless the
11 context clearly indicates otherwise:
12 "Commonwealth agency." An executive agency, an independent
13 agency or a State-affiliated agency.
14 "Government agency." Any of the following:
15 (1) A Commonwealth agency, transportation authority or
16 agency created by statute.
17 (2) A political subdivision or municipal or other local
18 authority or an agency of a political subdivision or
1 municipal or other local authority.
2 "Political subdivision." A county, city, borough,
3 incorporated town, township, school district, career and
4 technical school district and county institution district.
5 Section 3. Federal grants.
6 (a) Contract language.--A grant contract entered into by a
7 government agency which is funded, in whole or in part, by
8 Federal funds, including pass-through funds, shall include the
9 following language:
10 This award is funded, in whole or in part, by Federal
11 funds. Therefore, all applicable Federal grant
12 guidelines, including, but not limited to, 2 CFR 200 and
13 the special conditions listed on the government agency's
14 Federal award(s), are applicable to this award.
15 (b) Procurement guidelines.--A grant recipient shall follow
16 Federal procurement guidelines as identified in 2 CFR 200.320
17 (relating to procurement methods).
18 Section 4. Effective date.
19 This act shall take effect in 60 days.
