                                    AN ACT
 1   Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
 2      act relating to the public school system, including certain
 3      provisions applicable as well to private and parochial
 4      schools; amending, revising, consolidating and changing the
 5      laws relating thereto," in preliminary provisions, providing
 6      for limitation on school mascots.
 7      The General Assembly of the Commonwealth of Pennsylvania
 8   hereby enacts as follows:
 9      Section 1.    The act of March 10, 1949 (P.L.30, No.14), known
10   as the Public School Code of 1949, is amended by adding a
11   section to read:
12      Section 135.    Limitation on School Mascots.--(a)   A school
13   entity may not have or adopt a name, symbol or image that
14   depicts or refers to a Native American tribe, individual, custom
15   or tradition for a mascot, nickname, logo or letterhead unless
16   the school entity:
17      (1)   Has received the express written consent of a tax-exempt
18   corporation in good standing founded prior to 1945 whose mission
19   focuses exclusively on Native American rights.
20      (2)   Conducts a school-wide program on Native American
 1   culture at least twice per school year.
 2      (3)   Offers a course of study to the school entity's students
 3   outlining Native American contributions to society.
 4      (4)   Files an annual report with the State Board of Education
 5   detailing what academic programs on Native American culture and
 6   history the school entity has offered during the school year.
 7      (b)   A school entity that fails to comply with this section
 8   shall be ineligible to be a member of the Pennsylvania
 9   Interscholastic Athletic Association or participate in
10   Pennsylvania Interscholastic Athletic Association sponsored
11   athletic contests.
12      (c)   As used in this section, the following words and phrases
13   shall have the meanings given to them in this subsection unless
14   the context clearly indicates otherwise:
15      "School entity."    Any of the following:
16      (1)   A school district.
17      (2)   An intermediate unit.
18      (3)   An area career and technical school.
19      (4)   A charter school, cyber charter school or regional
20   charter school.
21      (5)   A private school.
22      Section 2.     This act shall take effect in 60 days.
