                                     AN ACT
 1   Amending Title 27 (Environmental Resources) of the Pennsylvania
 2      Consolidated Statutes, providing for the rendering and
 3      transportation of inedible kitchen grease; and imposing
 4      penalties.
 5      The General Assembly of the Commonwealth of Pennsylvania
 6   hereby enacts as follows:
 7      Section 1.    Title 27 of the Pennsylvania Consolidated
 8   Statutes is amended by adding a chapter to read:
 9                                 CHAPTER 67
10                      RENDERING AND TRANSPORTATION OF
11                           INEDIBLE KITCHEN GREASE
12   Sec.
13   6701.   Definitions.
14   6702.   Establishment and maintenance of Statewide registry.
15   6703.   Registration.
16   6704.   Recordkeeping.
17   6705.   Suspension or revocation of registration.
18   6706.   Penalties.
19   6707.   Preemption.
 1   § 6701.   Definitions.
 2      The following words and phrases when used in this chapter
 3   shall have the meanings given to them in this section unless the
 4   context clearly indicates otherwise:
 5      "Department."    The Department of Environmental Protection of
 6   the Commonwealth.
 7      "Inedible kitchen grease."      Any fat or used cooking grease or
 8   oils from any source.
 9      "Registrant."    A person that is registered with the
10   department under this chapter to engage in the rendering or
11   transportation of inedible kitchen grease.
12      "Rendering."     All recycling, processing and conversion of
13   inedible kitchen grease into fats, oils, proteins and other
14   products that are used in the animal, poultry and pet food
15   industries and other industries.
16      "Transportation."      The movement of inedible kitchen grease
17   and the loading, unloading, collection or storage incidental to
18   that movement.
19   § 6702.   Establishment and maintenance of Statewide registry.
20      The department shall establish and maintain a Statewide
21   registry of all persons registered to engage in the rendering or
22   transportation of inedible kitchen grease in this Commonwealth
23   under this chapter.
24   § 6703.   Registration.
25      (a)    Offense defined.--It shall be unlawful for a person to
26   engage in the rendering or transportation of inedible kitchen
27   grease without being registered with the department in
28   accordance with this section.
29      (b)    Duty to register.--A person that engages in the
30   rendering or transportation of inedible kitchen grease shall

 1   register with the department in accordance with this section.
 2      (c)   Required information.--When registering with the
 3   department, a person that engages in the rendering or
 4   transportation of inedible kitchen grease shall provide the
 5   following to the department in a form and manner prescribed by
 6   the department:
 7            (1)   For a person engaged in the transportation of
 8      inedible kitchen grease:
 9                  (i)    The person's name and business address.
10                  (ii)    A description of the operations to be
11            performed.
12                  (iii)    The make, model and license plate number of
13            each vehicle to be used in the transportation of inedible
14            kitchen grease.
15                  (iv)    Proof of vehicle and liability insurance.
16                  (v)    A list of the names and driver's license numbers
17            of the drivers who will transport the inedible kitchen
18            grease.
19                  (vi)    A registration fee of $250.
20                  (vii)    Any other information that the department
21            requires.
22            (2)   For a person engaged in the rendering of inedible
23      kitchen grease:
24                  (i)    The person's name and business address.
25                  (ii)    A description of the operations to be
26            performed.
27                  (iii)    Proof of liability insurance.
28                  (iv)    The location of any facility that the person
29            will use for the rendering of inedible kitchen grease.
30                  (v)    A registration fee of $250.

 1                   (vi)   Any other information that the department
 2             requires.
 3      (d)    Length of registration.--Each registration under this
 4   section shall expire on December 31 each year.
 5      (e)    Records for future registration.--After an initial
 6   registration, a person that engages in the rendering or
 7   transportation of inedible kitchen grease shall include the
 8   records specified in section 6704 (relating to recordkeeping)
 9   with every subsequent registration.
10      (f)    Proof of registration.--
11             (1)   The department shall issue a registration decal to a
12      person that is registered to transport inedible kitchen
13      grease. The registrant shall conspicuously display the
14      registration decal on each vehicle used in the transportation
15      of inedible kitchen grease.
16             (2)   The department shall issue a registration
17      certificate to a person that is registered to render inedible
18      kitchen grease. The registrant shall conspicuously display
19      the registration certificate at each facility used for the
20      rendering of inedible kitchen grease.
21      (g)    Refusal.--The department may refuse to register a person
22   that fails to comply with the provisions of this chapter.
23      (h)    Appeal.--
24             (1)   A person may appeal a decision of the department
25      regarding the refusal to register.
26             (2)   The department shall establish procedures for the
27      appeals process, which must provide for notice and a hearing.
28             (3)   The department may reverse a decision regarding the
29      refusal to register upon a finding of good cause to do so.
30   § 6704.    Recordkeeping.

 1      (a)    Rendering.--A registrant who engages in the rendering of
 2   inedible kitchen grease shall record and maintain for two years
 3   the following:
 4             (1)   The name of each person who has transported inedible
 5      kitchen grease to the registrant.
 6             (2)   The quantity of inedible kitchen grease received at
 7      each facility of the registrant where the rendering of
 8      inedible kitchen grease occurs.
 9             (3)   The date on which the registrant received inedible
10      kitchen grease at each facility where the rendering of
11      inedible kitchen grease occurs.
12      (b)    Transportation.--A registrant who engages in the
13   transportation of inedible kitchen grease shall record and
14   maintain for two years the following:
15             (1)   The name and address of each facility from which the
16      registrant received inedible kitchen grease, the quantity of
17      inedible kitchen grease received from each facility and each
18      date that the inedible kitchen grease was received.
19             (2)   The name and address of each facility to which the
20      registrant delivered inedible kitchen grease, the quantity of
21      inedible kitchen grease delivered to each facility and each
22      date that the inedible kitchen grease was delivered.
23      (c)    Location of records.--All records required to be
24   retained in accordance with this section shall be retained at
25   the regular place of business of each registrant for two years
26   and shall be exhibited to any authorized employee of the
27   department upon request.
28   § 6705.    Suspension or revocation of registration.
29      (a)    Authorization.--The department may suspend or revoke the
30   registration of a registrant if the registrant has done any of

 1   the following:
 2             (1)   Violated any provision of this chapter.
 3             (2)   Knowingly sold or offered for sale inedible kitchen
 4      grease to a person who is not a registrant.
 5             (3)   Knowingly taken possession of inedible kitchen
 6      grease:
 7                   (i)    from a person who is not a registrant; or
 8                   (ii)    that has been stolen.
 9             (4)   Knowingly stolen, misappropriated, contaminated or
10      damaged inedible kitchen grease.
11      (b)    Maximum time period.--
12             (1)   Subject to paragraph (2), the department shall adopt
13      policies that specify the maximum time period during which a
14      suspension or revocation may be imposed, based on the
15      severity or the number of violations that are the basis of
16      the department's action.
17             (2)   The time period for the suspension or revocation
18      shall not exceed three years from the date the suspension or
19      revocation is imposed.
20      (c)    Appeal.--
21             (1)   A registrant may appeal a decision of the department
22      regarding the suspension or revocation of the registration.
23             (2)   The department shall establish procedures for the
24      appeals process, which must provide for notice and a hearing.
25             (3)   The department may reverse a decision regarding the
26      suspension or revocation upon a finding of good cause to do
27      so.
28   § 6706.    Penalties.
29      (a)    Noncompliance with registration requirements and
30   engaging in prohibited activities.--If a person engages in the

 1   rendering or transportation of inedible kitchen grease and
 2   either fails to register with the department in accordance with
 3   section 6703 (relating to registration) or is found to have
 4   engaged in any of the activities specified under section 6705(a)
 5   (relating to suspension or revocation of registration), the
 6   person shall, upon conviction, be subject to a fine of not more
 7   than $5,000 for each violation.
 8      (b)    Noncompliance with recordkeeping requirements.--A
 9   registrant that violates section 6704 (relating to
10   recordkeeping) shall, upon conviction:
11             (1)   For a first offense, be subject to a fine of not
12      less than $1,000.
13             (2)   For a second offense within a period of one year, be
14      subject to:
15                   (i)    A fine of not less than $5,000.
16                   (ii)    The suspension or revocation of the
17             registration of the registrant by the department.
18             (3)   For a third or subsequent offense within a period of
19      two years, be subject to:
20                   (i)    A fine of not less than $10,000.
21                   (ii)    The suspension or revocation of the
22             registration of the registrant by the department.
23   § 6707.    Preemption.
24      This chapter shall preempt and supersede any ordinance,
25   policy or rule of a political subdivision related to the
26   rendering or transportation of inedible kitchen grease.
27      Section 2.         This act shall take effect in 60 days.
