                                     AN ACT
 1   Amending Title 53 (Municipalities Generally) of the Pennsylvania
 2      Consolidated Statutes, in prohibition options, providing for
 3      prohibitions on parking limitations; and making editorial
 4      changes.
 5      The General Assembly of the Commonwealth of Pennsylvania
 6   hereby enacts as follows:
 7      Section 1.    Chapter 5 heading of Title 53 of the Pennsylvania
 8   Consolidated Statutes is amended to read:
 9                                 CHAPTER 5
10             [PROHIBITION OPTIONS] MUNICIPAL PROHIBITIONS
11      Section 2.    Chapter 5 of Title 53 is amended by adding a
12   subchapter heading immediately after the Chapter 5 heading to
13   read:
14                                SUBCHAPTER A
15                   PROHIBITION OPTIONS RELATING TO GAMING
16      Section 3.    Chapter 5 of Title 53 is amended by adding a
17   subchapter to read:
18                                SUBCHAPTER B
 1                              OTHER PROHIBITIONS
 2   Sec.
 3   511.   Parking minimums.
 4   § 511.   Parking minimums.
 5      Except as required by the Americans with Disabilities Act of
 6   1990 (Public Law 101-336, 104 Stat. 327), a county, city,
 7   borough, incorporated town, township, home rule municipality,
 8   optional plan municipality or optional charter municipality in
 9   this Commonwealth may not require a minimum number of vehicular
10   parking spaces per land development or structure, as those terms
11   are defined in section 107 of the act of July 31, 1968 (P.L.805,
12   No.247), known as the Pennsylvania Municipalities Planning Code,
13   regardless of occupancy or use.
14      Section 4.   This act shall take effect in one year.
