                                    AN ACT
 1   Amending Title 74 (Transportation) of the Pennsylvania
 2      Consolidated Statutes, in turnpike, further providing for
 3      acquisition of property rights by commission and for
 4      procedural requirements of acquisition, repealing provisions
 5      relating to entry and possession of property condemned and
 6      prohibiting condemnation by commission.
 7      The General Assembly of the Commonwealth of Pennsylvania
 8   hereby enacts as follows:
 9      Section 1.    Sections 8109(a) and 8110(a) of Title 74 of the
10   Pennsylvania Consolidated Statutes are amended to read:
11   § 8109.    Acquisition of property rights by commission.
12      [(a)    Condemnation.--The commission may condemn, pursuant to
13   26 Pa.C.S. (relating to eminent domain), any lands, interests in
14   lands, property rights, rights-of-way, franchises, easements and
15   other property deemed necessary or convenient for the
16   construction and efficient operation of the turnpikes and the
17   toll road conversions or necessary in the restoration or
18   relocation of public or private property damaged or destroyed.]

20   § 8110.    Procedural requirements of acquisition.
 1      [(a)    Title.--Title to any property condemned by the
 2   commission shall be taken in the name of the commission.]
 3      * * *
 4      Section 2.     Section 8111 of Title 74 is repealed:
 5   [§ 8111.    Entry and possession of property condemned.
 6      Whenever the commission has condemned any lands, rights,
 7   rights-of-way, easements and franchises, or interests therein,
 8   as provided in this chapter, the commission may proceed to
 9   obtain possession in the manner provided by 26 Pa.C.S. (relating
10   to eminent domain).]
11      Section 3.     Section 8122 of Title 74 is amended to read:
12   § 8122.    [Reserved.] Condemnation by commission prohibited.
13      The commission may not condemn, for the purposes of
14   acquisition and possession in accordance with 26 Pa.C.S.
15   (relating to eminent domain) or otherwise, any lands, interests
16   in lands, property rights, rights-of-way, franchises, easements
17   or other property.
18      Section 4.     This act shall not apply to:
19             (1)   A proceeding commenced under 26 Pa.C.S. before the
20      effective date of this paragraph.
21             (2)   An action taken by the commission before the
22      effective date of this paragraph.
23      Section 5.     This act shall take effect in 60 days.
