                                     AN ACT
 1   Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
 2      act relating to the public school system, including certain
 3      provisions applicable as well to private and parochial
 4      schools; amending, revising, consolidating and changing the
 5      laws relating thereto," in pupils and attendance, further
 6      providing for exceptional children, education and training.
 7      The General Assembly of the Commonwealth of Pennsylvania
 8   hereby enacts as follows:
 9      Section 1.    Section 1372 of the act of March 10, 1949
10   (P.L.30, No.14), known as the Public School Code of 1949, is
11   amended by adding a paragraph to read:
12      Section 1372.     Exceptional Children; Education and
13   Training.--* * *
14      (9)   Time Period for Initial Evaluation to Determine Children
15   with Disabilities.
16      (i)   An initial evaluation by a school entity to determine
17   whether a child is a child with a disability under Federal law
18   shall be completed and a copy of the evaluation shall be
19   presented to the parents of the child not later than sixty (60)
20   consecutive school days after the school entity receives
1   parental consent for the evaluation.
2      (ii)   For the purpose of this paragraph, the term "school
3   entity" means a school district, intermediate unit, approved
4   private school, State-operated program or facility or other
5   public or private organization that provides educational
6   services to children with disabilities or early intervention
7   services. The term does not include a charter school or cyber
8   charter school under Article XVII-A.
9      Section 2.   This act shall take effect in 60 days.
