                                    AN ACT
 1   Amending the act of April 17, 2016 (P.L.84, No.16), entitled "An
 2      act establishing a medical marijuana program; providing for
 3      patient and caregiver certification and for medical marijuana
 4      organization registration; imposing duties on the Department
 5      of Health; providing for a tax on medical marijuana
 6      organization gross receipts; establishing the Medical
 7      Marijuana Program Fund; establishing the Medical Marijuana
 8      Advisory Board; establishing a medical marijuana research
 9      program; imposing duties on the Department of Corrections,
10      the Department of Education and the Department of Human
11      Services; and providing for academic clinical research
12      centers and for penalties and enforcement," in practitioners,
13      further providing for practitioner registration.
14      The General Assembly of the Commonwealth of Pennsylvania
15   hereby enacts as follows:
16      Section 1.    Section 401 of the act of April 17, 2016 (P.L.84,
17   No.16), known as the Medical Marijuana Act, is amended by adding
18   a subsection to read:
19   Section 401.    Practitioner registration.

21      (d)   Department authority.--The department may place one or
22   more conditions on a practitioner for inclusion in the registry,
23   including:
 1        (1)    A term of probation.
 2        (2)    A limitation on the number of certifications the
 3    practitioner may issue within a set time frame. The time
 4    frame may be extended by the department if the extension is
 5    necessary to protect the health and safety of patients in the
 6    program.
 7        (3)    Supervision by another practitioner who has agreed
 8    to oversee the practitioner for a set time frame. The time
 9    frame may be extended by the department if an extension is
10    necessary to protect the health and safety of patients in the
11    program.
12        (4)    Reporting requirements to the department, including
13    the submission of documentation necessary for the department
14    to ensure that the practitioner is complying with this act
15    and any conditions placed upon the practitioner.
16        (5)    Any other condition that the department determines
17    is necessary to protect the health and safety of patients in
18    the program.
19    Section 2.    This act shall take effect in 60 days.
