AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, in nuisances, providing for the
3 offense of late removal of campaign signage on public
4 property; and imposing a penalty.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Title 18 of the Pennsylvania Consolidated
8 Statutes is amended by adding a section to read:
9 § 6506. Late removal of campaign signage on public property.
10 (a) Offense defined.--A candidate, or person acting on
11 behalf of a candidate, who posts campaign signage on public
12 property in furtherance of a political campaign shall:
13 (1) abide by all lawful local ordinances which are
14 applicable to signage; and
15 (2) remove the signage by the date lawfully required by
16 applicable local ordinance, but not later than 10 days
17 following an election.
18 (b) Penalty.--A candidate who violates this section is
19 guilty of a summary offense and, upon conviction, shall be
1 sentenced to pay a fine of not less than $50 nor more than $300
2 and shall be sentenced to not less than five hours nor more than
3 30 hours of community service to be completed in six months in
4 which the defendant is required to pick up campaign signs as
5 well as litter or illegally dumped trash.
6 (c) Definition.--As used in this section, the term
7 "candidate" means an individual who seeks nomination or election
8 to public office by vote of the electorate.
9 Section 2. This act shall take effect in 60 days.
