                                    AN ACT
 1   Amending the act of April 12, 1951 (P.L.90, No.21), entitled "An
 2      act relating to alcoholic liquors, alcohol and malt and
 3      brewed beverages; amending, revising, consolidating and
 4      changing the laws relating thereto; regulating and
 5      restricting the manufacture, purchase, sale, possession,
 6      consumption, importation, transportation, furnishing, holding
 7      in bond, holding in storage, traffic in and use of alcoholic
 8      liquors, alcohol and malt and brewed beverages and the
 9      persons engaged or employed therein; defining the powers and
10      duties of the Pennsylvania Liquor Control Board; providing
11      for the establishment and operation of State liquor stores,
12      for the payment of certain license fees to the respective
13      municipalities and townships, for the abatement of certain
14      nuisances and, in certain cases, for search and seizure
15      without warrant; prescribing penalties and forfeitures;
16      providing for local option, and repealing existing laws," in
17      licenses and regulations, liquor, alcohol and malt and brewed
18      beverages, further providing for sales by liquor licensees
19      and restrictions, for retail dispensers' restrictions on
20      purchases and sales, for breweries and for unlawful acts
21      relative to liquor, malt and brewed beverages and licensees.
22      The General Assembly of the Commonwealth of Pennsylvania
23   hereby enacts as follows:
24      Section 1.    Sections 406(f)(9) and (10) introductory
25   paragraph, 442(f)(9) introductory paragraph and (10) and 446(b)
26   (9) and (10) introductory paragraph of the act of April 12, 1951
27   (P.L.90, No.21), known as the Liquor Code, are amended and the
 1   subsections are amended by adding paragraphs to read:
 2      Section 406.   Sales by Liquor Licensees; Restrictions.--* * *
 3      (f)    The holder of a hotel or restaurant liquor license may
 4   obtain an off-premises catering permit subject to section
 5   493(33) to hold a catered function off the licensed premises and
 6   on otherwise unlicensed premises where the licensee may sell
 7   wine, liquor and malt or brewed beverages by the glass, open
 8   bottle or other container, and in any mixture together with
 9   food, for consumption on those premises. Functions conducted
10   under the authority of the permit shall be subject to the
11   following:

13      (9)    except as provided under paragraph (10.1), written
14   notice of the catered function as enumerated in paragraph (10)
15   shall be provided to the local police and the enforcement bureau
16   at least seven days in advance of the event;
17      (10)    except as provided under paragraph (10.1), written
18   notice shall be provided to the board at least fourteen days
19   prior to a catered function. Written notice must include the
20   location of the function, time of the function, host of the
21   function, general information regarding the guests expected at
22   the function as well as any information the board shall from
23   time to time prescribe. The board may, in its discretion, accept
24   notice in an electronic format. The board may, in its
25   discretion, waive the fourteen-day notice period for a catered
26   function if:

28      (10.1)    if the catered function is part of an end-of-life
29   memorial event, notice to the local police, the enforcement
30   bureau and the board shall not be required more than 24 hours

 1   before the catered event. For purposes of this paragraph, an
 2   "end-of-life memorial event" is a gathering of people where
 3   guests honor a person who died within the previous seven days;
 4      * * *
 5      Section 442.     Retail Dispensers' Restrictions on Purchases
 6   and Sales.--* * *
 7      (f)    The holder of an eating place retail dispenser license
 8   may obtain an off-premises catering permit under section 493(33)
 9   to hold a catered function off of the licensed premises and on
10   otherwise unlicensed premises where the licensee may sell malt
11   or brewed beverages by the glass, open bottle or any other
12   container, together with food, for consumption on those premises
13   solely used for catering premises. Functions conducted under the
14   authority of the permit shall be subject to the following:

16      (9)    except as provided under paragraph (10.1), written
17   notice shall be provided to the board at least fourteen days
18   prior to a catered function. Written notice must include the
19   location of the function, time of the function, host of the
20   function, general information regarding the guests expected at
21   the function as well as any information the board shall from
22   time to time prescribe. The board may, in its discretion, accept
23   notice in an electronic format. The board may, in its
24   discretion, waive the fourteen-day notice period for a catered
25   function if:

27      (10)    except as provided under paragraph (10.1), the board
28   shall, in its discretion, approve or disapprove a catered
29   function if the applicant fails to provide timely notice of the
30   catered function, does not intend to conduct a function that

 1   meets the requirements of this act or has previously conducted a
 2   function that did not meet the requirements of this act;
 3      (10.1)   if the catered function is part of an end-of-life
 4   memorial event, notice to the local police, the enforcement
 5   bureau and the board shall not be required more than 24 hours
 6   before the catered event. For purposes of this paragraph, an
 7   "end-of-life memorial event" is a gathering of people where
 8   guests honor a person who died within the previous seven days;

10      Section 446.    Breweries.--* * *
11      (b)    The holder of a brew pub license may obtain an off-
12   premises catering permit subject to section 493(33) to hold a
13   catered function off the licensed premises and on otherwise
14   unlicensed premises where the licensee may sell wine produced by
15   a licensed limited winery and malt or brewed beverages produced
16   by the brewery by the glass, open bottle or other container
17   together with food, and in any mixture, for consumption on those
18   premises. Functions conducted under the authority of the permit
19   shall be subject to the following:

21      (9)    except as provided under paragraph (10.1), written
22   notice of the catered function as enumerated in paragraph (10)
23   shall be provided to the local police and the enforcement bureau
24   at least seven days in advance of the event;
25      (10)    except as provided under paragraph (10.1), written
26   notice shall be provided to the board at least fourteen days

11      Section 2.   Section 493(33) of the act is amended to read:
12      Section 493.   Unlawful Acts Relative to Liquor, Malt and
13   Brewed Beverages and Licensees.--The term "licensee," when used
14   in this section, shall mean those persons licensed under the
15   provisions of Article IV, unless the context clearly indicates
16   otherwise.
17      It shall be unlawful--

19      (33)    Off-premises Catering Permit; Fees. For any licensee,
20   his servants, agents or employes to sell alcohol at a location
21   other than its licensed premises, unless the sale is
22   specifically authorized under this act, or unless the licensee
23   receives a special permit from the board to do so. Only those
24   licensees holding a current and valid restaurant, hotel, brew
25   pub or eating place license shall be allowed to apply for such a
26   permit. Any licensee that wishes to obtain an off-premises
27   catering permit must notify the board and pay the permitting
28   fee. If a licensee notifies the board and pays the permitting
29   fee and does not then use the permit throughout the calendar
30   year, the licensee shall not be entitled to a return of the

 1   permitting fee. A licensee shall apply for the permit at least
 2   sixty days prior to the first catered function. All servers at
 3   the off-premises catered function shall be certified under the
 4   board's responsible alcohol management program as required under
 5   section 471.1. The board may charge a fee of five hundred
 6   dollars ($500) each calendar year, to each applicant for the
 7   initial permit associated with a particular license, but no
 8   further fee shall be charged for any subsequent permits issued
 9   to the applicant for the license during the same calendar year.
10   [The] Unless otherwise provided for by this act, the applicant
11   shall submit written notice to the board thirty days prior to
12   each catered event[, unless this]. The time frame [has been] may
13   be waived by the board, and the board may approve or disapprove
14   each event if the applicant fails to provide timely notice of
15   the catered function, does not intend to conduct a function that
16   meets the requirements of this act or has previously conducted a
17   function that did not meet the requirements of this act. The
18   fees shall be paid into the State Stores Fund. Any violation of
19   this act or the board's regulations for governing activity
20   occurring under the authority of this permit may be the basis
21   for the issuance of a citation under section 471, the nonrenewal
22   of the license under section 470 or the refusal by the board to
23   issue subsequent permits or honor subsequent dates on the
24   existing permit. This penalty shall be in addition to any other
25   remedies available to the enforcement bureau or the board.

27      Section 3.   This act shall take effect in 60 days.
