                                    AN ACT
 1   Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
 2      Statutes, in registration of vehicles, providing for arts
 3      registration plate; in fees, further providing for payments
 4      to special funds; and establishing the Arts Promotion Fund.
 5      The General Assembly of the Commonwealth of Pennsylvania
 6   hereby enacts as follows:
 7      Section 1.    Title 75 of the Pennsylvania Consolidated
 8   Statutes is amended by adding a section to read:
 9   § 1352.3.   Arts registration plate.
10      The department, in consultation with the Council on the Arts,
11   shall design a special arts registration plate. Upon application
12   of any person, accompanied by a fee of $41, which shall be in
13   addition to the annual registration fee, the department shall
14   issue the plate for a passenger car, motor home, trailer or
15   truck with a registered gross weight of not more than 14,000
16   pounds. The Arts Promotion Fund established in section 1905(e)
17   (relating to payments to special funds) shall receive $15 of the
18   fee paid by the applicant for the plate.
19      Section 2.    Section 1905 of Title 75 is amended by adding a
 1   subsection to read:
 2   § 1905.    Payments to special funds.
 3      * * *
 4      (e)    Arts Promotion Fund.--
 5             (1)   The Arts Promotion Fund is established within the
 6      State Treasury for the purpose of providing grants for the
 7      arts.
 8             (2)   Fifteen dollars of each fee received under section
 9      1352.3 (relating to arts registration plate) shall be
10      credited to the Arts Promotion Fund.
11             (3)   All money in the Arts Promotion Fund is appropriated
12      on a continuing basis to the Council on the Arts and may be
13      expended, subject to paragraph (5), for the purposes
14      authorized under this subsection.
15             (4)   Estimates of amounts to be expended under this
16      subsection shall be submitted to the Governor by the Council
17      on the Arts for approval.
18             (5)   The State Treasurer may not honor any requisition
19      for expenditures by the Council on the Arts in excess of
20      estimates approved by the Governor or in excess of the amount
21      available for the purposes for which the requisition was
22      made, whichever is the lesser amount.
23      Section 3.     This act shall take effect in 60 days.
