                                     AN ACT
 1   Amending the act of June 30, 2011 (P.L.81, No.18), entitled "An
 2      act providing for the establishment of a searchable budget
 3      database-driven Internet website detailing certain
 4      information concerning taxpayer expenditures and
 5      investments," further providing for searchable budget
 6      database and for administration.
 7      The General Assembly of the Commonwealth of Pennsylvania
 8   hereby enacts as follows:
 9      Section 1.     Section 3(g) of the act of June 30, 2011 (P.L.81,
10   No.18), known as the Pennsylvania Web Accountability and
11   Transparency (PennWATCH) Act, is amended and the section is
12   amended by adding a subsection to read:
13   Section 3.    Searchable budget database.
14      * * *
15      (f.1)     Settlements.--
16          (1)     The website shall include information on each
17      settlement paid to an employee of a Commonwealth agency or
18      paid to an individual as a result of an action taken by an
19      employee of a Commonwealth agency for each claim under the
 1      Employee Liability Self-Insurance Program, the Automobile
 2      Liability Self-Insurance Program, the Motor License Tort
 3      Claim Fund, notary bonds and the General Tort Claims Self-
 4      Insurance Fund. The information shall include all of the
 5      following:
 6                  (i)    The Commonwealth agency that is the subject of
 7            the claim.
 8                  (ii)    The date when the claim was filed.
 9                  (iii)    The legal basis for the settlement.
10                  (iv)    The date when the settlement was paid.
11                  (v)    The amount of the settlement.
12            (2)   No later than 30 days after the date when a
13      settlement is paid, the office shall post the information
14      under paragraph (1) on the website.
15            (3)   No later than 30 days after the effective date of
16      this paragraph and every 30 days thereafter, the Department
17      of General Services shall electronically transmit the
18      information under paragraph (1) regarding each settlement
19      paid in the previous 30 days to all the members of the
20      General Assembly.
21            (4)   No later than 30 days after the effective date of
22      this paragraph, the Department of General Services shall
23      electronically transmit the information under paragraph (1)
24      regarding each settlement paid in the period beginning
25      January 1, 2025, and ending on the effective date of this
26      paragraph to all the members of the General Assembly.
27      (g)     Exemption.--Notwithstanding subsections (a), (b) [and],
28   (f) and (f.1), the following shall not be included on the
29   website:
30            (1)   Records, data or other information exempted from

 1      disclosure under 24 Pa.C.S. § 8502(e)(2) (relating to
 2      administrative duties of board).
 3             (2)   Records, data or other information exempted from
 4      disclosure under 71 Pa.C.S. § 5902(e)(2) (relating to
 5      administrative duties of the board).
 6             (3)   Records not subject to disclosure under the act of
 7      February 14, 2008 (P.L.6, No.3), known as the Right-to-Know
 8      Law.
 9      * * *
10      Section 2.         Section 4(a) of the act is amended by adding a
11   paragraph to read:
12   Section 4.      Administration.
13      (a)    Commonwealth agency requirements.--Each Commonwealth
14   agency shall cooperate with the Governor's Office of
15   Administration. The following shall apply:

17             (3)   Each Commonwealth agency shall provide the office
18      with information on each settlement paid for each claim
19      settled as required under section 3(f.1):
20                   (i)    Within five business days of the date of the
21             settlement.
22                   (ii)    Before the office posts the information on the
23             website.

25      Section 3.         This act shall take effect immediately.
