                                    AN ACT
 1   Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
 2      act relating to the public school system, including certain
 3      provisions applicable as well to private and parochial
 4      schools; amending, revising, consolidating and changing the
 5      laws relating thereto," in the State System of Higher
 6      Education, further providing for Board of Governors.
 7      The General Assembly of the Commonwealth of Pennsylvania
 8   hereby enacts as follows:
 9      Section 1.    Section 2004-A(a)(7) of the act of March 10, 1949
10   (P.L.30, No.14), known as the Public School Code of 1949, is
11   amended to read:
12      Section 2004-A.    Board of Governors.--(a)   The system shall
13   be governed and all of its corporate powers exercised by the
14   Board of Governors, which shall consist of twenty (20) members
15   to be appointed as follows:

17      (7)   Eleven (11) members shall be appointed by the Governor
18   with the advice and consent of the Senate, of which:
19      (i)   six (6) members shall be selected from the residents of
20   this Commonwealth [and five (5)];
 1      (ii)    three (3) members shall be selected from trustees of
 2   constituent institutions, except that no more than one trustee
 3   may represent a constituent institution[.];
 4      (iii)   one (1) member must be a current or retired member of
 5   the State system bargaining unit of the American Federation of
 6   State, County and Municipal Employees and selected by the
 7   governing board of the bargaining unit; and
 8      (iv)    one (1) member must be a current or retired member of
 9   the State system bargaining unit of the Association of
10   Pennsylvania State College and University Faculties and selected
11   by the governing board of the bargaining unit.
12   A member appointed under this paragraph must have expertise or
13   substantial experience in at least one area, including
14   postsecondary education, finance, business, nonprofit
15   management, law or public administration.

17      Section 2.   This act shall take effect immediately.
