                                     AN ACT
 1   Authorizing the Department of General Services, with the
 2      approval of the Governor, to grant and convey to Susquehanna
 3      Regional Transportation Authority certain lands and buildings
 4      situate in the City of Harrisburg, Dauphin County.
 5      The General Assembly of the Commonwealth of Pennsylvania
 6   hereby enacts as follows:
 7   Section 1.    Conveyance in City of Harrisburg, Dauphin County.
 8      (a)     Authorization.--The Department of General Services, with
 9   the approval of the Governor, is hereby authorized on behalf of
10   the Commonwealth of Pennsylvania to grant and convey to
11   Susquehanna Regional Transportation Authority certain lands and
12   buildings situate in the City of Harrisburg, Dauphin County, for
13   fair market value, as determined by an appraisal, under terms
14   and conditions to be established in an agreement of sale.
15      (b)     Property description.--The property to be conveyed under
16   subsection (a) consists of approximately 2.857 acres and
17   improvements thereon, bounded and more particularly described as
18   follows:
19      ALL THAT CERTAIN tract of land situate in the City of
 1   Harrisburg, Dauphin County, Pennsylvania, being more fully
 2   bounded and described as follows, to wit:
 3      Beginning at a 5/8" rebar set on the eastern legal right-of-
 4   way line of North Cameron Street, and being South 15 degrees 16
 5   minutes 47 seconds East for a distance of 300.91 feet from the
 6   southerly right-of-way line of Goodwill Drive;
 7      THENCE North 60 degrees 52 minutes 36 seconds East for a
 8   distance of 123.71 feet to a point on the eastern legal right-
 9   of-way line of Florence Street;
10      THENCE along the eastern legal right-of-way line of Florence
11   Street, North 15 degrees 16 minutes 55 seconds West for a
12   distance of 271.31 feet to a 5/8" rebar found at the
13   intersection of the southern legal right-of-way line of Goodwill
14   Drive and the eastern legal right-of-way line of Florence
15   Street;
16      THENCE along the southern legal right-of-way line of Goodwill
17   Drive, North 74 degrees 43 minutes 05 seconds East for a
18   distance of 384.00 feet to a 5/8" rebar at the intersection of
19   the southern legal right-of-way line of Goodwill Drive and the
20   western legal right-of-way line of Dr. Claude E. Nichols Street;
21      THENCE along the western legal right-of-way line of Dr.
22   Claude E. Nichols Street, South 15 degrees 16 minutes 55 seconds
23   East for a distance of 176.70 feet to a 5/8" rebar set;
24      THENCE North 60 degrees 52 minutes 36 seconds East for a
25   distance of 33.78 feet to a 5/8" rebar set on the line of lands
26   of the Harrisburg Cemetery Association;
27      THENCE along the lands of the Harrisburg Cemetery
28   Association, South 16 degrees 39 minutes 58 seconds East for a
29   distance of 61.58 feet to a point in the State Street Ramp from
30   North Cameron Street to 13th Street;

 1      THENCE in and through the said State Street Ramp, South 58
 2   degrees 58 minutes 47 seconds West for a distance of 559.38 feet
 3   to a point on the eastern legal right-of-way line of North
 4   Cameron Street;
 5      THENCE along the eastern legal right-of-way line of North
 6   Cameron Street, North 15 degrees 16 minutes 47 seconds West for
 7   a distance of 81.00 feet to the place of beginning.
 8      Containing 2.857 acres or 124,449 square feet, gross.
 9      (c)   Subject to certain matters.--The conveyance shall be
10   made under and subject to all lawful and enforceable easements,
11   servitudes and rights of others, including, but not confined to,
12   highway rights-of-way, including, without limitation, the right-
13   of-way for the State Street Bridge, SR 3014, and the right-of-
14   way for the ramp to 13th Street adjoining such bridge, SR 3028,
15   streets, roadways and rights of any telephone, telegraph, water,
16   electric, gas or pipeline companies, as well as under and
17   subject to any lawful and enforceable estates or tenancies
18   vested in third persons appearing of record, for any portion of
19   the land or improvements erected thereon.
20      (d)   Prohibited use.--Any conveyance authorized under this
21   act shall be made under and subject to the condition, which
22   shall be contained in the deed of conveyance, that no portion of
23   the property conveyed shall be used as a licensed facility, as
24   defined in 4 Pa.C.S. § 1103 (relating to definitions), or any
25   other similar type of facility authorized under State law. The
26   condition shall be a covenant running with the land and shall be
27   binding upon the grantee, its successors and assigns. Should the
28   grantee, its successors or assigns permit any portion of the
29   property authorized to be conveyed under this section to be used
30   in violation of this subsection, the title shall immediately

 1   revert to and revest in the grantor.
 2      (e)   Conditions and restrictions.--The Secretary of General
 3   Services may include in the deed of conveyance any covenants,
 4   conditions or restrictions on the property as determined to be
 5   in the best interests of the Commonwealth.
 6      (f)   Easements.--The Department of General Services is hereby
 7   authorized, on behalf of the Commonwealth of Pennsylvania, to
 8   grant any easements benefiting the property to be conveyed, or
 9   to retain any easements from the property to be conveyed, as the
10   Secretary of General Services shall determine to be necessary or
11   appropriate.
12      (g)   Deed of conveyance.--The conveyance shall be made by
13   special warranty deed to be executed by the Secretary of General
14   Services in the name of the Commonwealth of Pennsylvania.
15      (h)   Costs and fees.--Costs and fees incidental to this
16   conveyance shall be borne by the grantee.
17      (i)   Alternate disposition.--In the event that this
18   conveyance is not executed within 24 months after the effective
19   date of this subsection, the property may be disposed of by a
20   competitive bidding process in accordance with section 2405-A of
21   the act of April 9, 1929 (P.L.177, No.175), known as The
22   Administrative Code of 1929, except that no property disposition
23   plan shall be required.
24      (j)   Proceeds.--The proceeds from the conveyance authorized
25   under this section shall be deposited into the General Fund.
26   Section 2.   Effective date.
27      This act shall take effect immediately.
