                                     AN ACT
 1   Amending the act of July 2, 2019 (P.L.366, No.56), entitled "An
 2      act providing for sports raffles for charity; and making
 3      related repeals," further providing for athletic event
 4      drawing.
 5      The General Assembly of the Commonwealth of Pennsylvania
 6   hereby enacts as follows:
 7      Section 1.     Section 4(e) of the act of July 2, 2019 (P.L.366,
 8   No.56), known as the Sports Raffle Charities Act, is amended and
 9   the section is amended by adding a subsection to read:
10   Section 4.     Athletic event drawing.
11      * * *
12      (e)   Distribution.--
13            (1)   The prize amount of an athletic event drawing shall
14      be 50% of the total amount collected from the sale of
15      athletic event drawing tickets. Except as provided under
16      subsection (f), the other 50% of the total amount collected
17      from the sale of athletic event drawing tickets shall be
18      donated [within seven days from the date of the drawing by
 1    the] by each affiliated nonprofit organization conducting
 2    [the] an athletic event drawing [to one] as follows:
 3              (i)    Ninety-five percent shall be donated within
 4        seven days from the date of the drawing to one or more
 5        designated charitable organizations for which the drawing
 6        was conducted and shall be used exclusively for public
 7        interest purposes.
 8              (ii)    Five percent shall be used to fund grants
 9        issued by the Office of State Fire Commissioner under 35
10        Pa.C.S. Ch. 78 Subchs. B (relating to Fire Company Grant
11        Program) and C (relating to Emergency Medical Services
12        Grant Program).
13        (2)   Beginning on the first June 30 one year after the
14    effective date of this paragraph, and each June 30
15    thereafter, an affiliated nonprofit organization under
16    paragraph (1) shall remit the amount collected under
17    paragraph (1)(ii) in the prior year to the department. The
18    department shall report the amount remitted under paragraph
19    (1)(ii) to the State Treasurer. The State Treasurer shall
20    transfer the amount to a restricted revenue account within
21    the General Fund to fund grants issued by the Office of State
22    Fire Commissioner under 35 Pa.C.S. Ch. 78 Subchs. B and C.

24    (k.1)   Report.--
25        (1)   Each affiliated nonprofit organization that conducts
26    an athletic event drawing shall compile a report with all of
27    the following information for the prior year:
28              (i)    The total amount collected from the sale of
29        athletic event drawing tickets.
30              (ii)    The total amount donated to one or more

 1        designated charitable organizations for which the
 2        athletic event drawing was conducted under subsection (e)
 3        (1)(i).
 4              (iii)    The total amount remitted under subsection (e)
 5        (1)(ii) to fund grants issued by the Office of State Fire
 6        Commissioner under 35 Pa.C.S. Ch. 78 Subchs. B and C.
 7        (2)   No later than the first September 30 following the
 8    first remittance date under subsection (e)(2), and each
 9    September 30 thereafter, each affiliated nonprofit
10    organization shall submit the report under paragraph (1) to
11    the State Treasurer on a form prescribed by the State
12    Treasurer. The State Treasurer shall submit the report to all
13    of the following:
14              (i)    The department.
15              (ii)    The chair and minority chair of the
16        Appropriations Committee of the Senate.
17              (iii)    The chair and minority chair of the
18        Appropriations Committee of the House of Representatives.
19              (iv)    The chair and minority chair of the Veterans
20        Affairs and Emergency Preparedness Committee of the
21        Senate.
22              (v)    The chair and minority chair of the Veterans
23        Affairs and Emergency Preparedness Committee of the House
24        of Representatives.

26    Section 2.      This act shall take effect in 30 days.
