                                    AN ACT
 1   Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
 2      act relating to the public school system, including certain
 3      provisions applicable as well to private and parochial
 4      schools; amending, revising, consolidating and changing the
 5      laws relating thereto," in certification of teachers,
 6      repealing provisions relating to CPR instruction; in school
 7      safety and security, further providing for School Safety and
 8      Security Grant Program; and, in school health services,
 9      further providing for definitions, repealing provisions
10      relating to automatic external defibrillators, providing for
11      AED and CPR instruction and procedure, establishing the
12      Automated External Defibrillator Program and providing for
13      availability and specifications of automated external
14      defibrillators.
15      This act shall be known and may be cited as Greg Moyer's Law.
16      The General Assembly of the Commonwealth of Pennsylvania
17   hereby enacts as follows:
18      Section 1.    Section 1205.4 of the act of March 10, 1949
19   (P.L.30, No.14), known as the Public School Code of 1949, is
20   repealed:
21      [Section 1205.4.    CPR Instruction.--(a)   School entities
22   shall be required to offer a cardiopulmonary resuscitation
23   training (CPR) class on school premises at least once every
24   three years. The course shall be offered as an option to all
 1   employes of the school entity.
 2      (b)    Completion of training, including testing of skills and
 3   knowledge, shall be documented by the signature and title of a
 4   representative of the training entity and shall include the date
 5   training was completed. Documentation shall be retained in the
 6   facility in that employe's file. Training shall be conducted by:
 7      (1)    the American Red Cross;
 8      (2)    the American Heart Association;
 9      (3)    an individual certified to conduct CPR training by the
10   American Red Cross, American Heart Association or other
11   certifying agency approved by the Department of Health; or
12      (4)    other certifying agency approved by the Department of
13   Health.
14      (c)    School districts may include this training in the
15   continuing education plan submitted by the district to the
16   Department of Education under section 1205.1.
17      (d)    For purposes of this section, a school entity shall be
18   defined as a local school district, intermediate unit or area
19   career and technical school.]
20      Section 2.     Section 1306-B(h)(4) of the act is amended and
21   the subsection is amended by adding paragraphs to read:
22   Section 1306-B.     School Safety and Security Grant Program.
23      * * *
24      (h)    School Safety and Security Fund.--
25             * * *
26             (4)   The fund may only be used for the grant programs
27      authorized under this article and for providing automated
28      external defibrillators and training under section 1423.2 and
29      no money in the fund may be transferred or diverted to any
30      other purpose by administrative action.

 2             (14)    Notwithstanding any other provision of law, during
 3      fiscal years 2025-2026 through 2029-2030, not less than 2.5%
 4      of the money in the fund shall be transferred to the
 5      department for the purchase of or providing discounts for
 6      automated external defibrillators under section 1423.2. Any
 7      amount of the money transferred by the commission to the
 8      department that is unexpended, uncommitted or unencumbered by
 9      the department by September 30 of each succeeding fiscal year
10      must be returned to the fund.
11             (15)    Notwithstanding any other provision of law, during
12      fiscal years 2025-2026 through 2029-2030, not less than 2.5%
13      of the money in the fund shall be used for training grants
14      for automated external defibrillators under section 1423.2 to
15      school entities and nonpublic schools. Any amount of money
16      that is unexpended, uncommitted or unencumbered by the
17      commission by September 30 of each succeeding fiscal year
18      must be returned by the fund.
19      * * *
20      Section 3.      Section 1401 of the act is amended by adding a
21   definition to read:
22      Section 1401.      Definitions.--As used in this article--
23      * * *
24      (17)    "Automated external defibrillator" or "AED" means a
25   portable device that uses electric shock to restore a stable
26   heart rhythm to an individual in cardiac arrest.
27      Section 4.      Section 1423 of the act is repealed:
28      [Section 1423.      Automatic External Defibrillators.--(a)   The
29   department shall establish an automatic external defibrillator
30   program to assist school entities and nonpublic schools in

 1   making automatic external defibrillators available in school
 2   buildings.
 3      (b)   On a biennial basis, the department, in consultation
 4   with the Department of General Services and the Department of
 5   Health, shall issue an invitation to bid for the cost of
 6   automatic external defibrillators and other equipment and
 7   supplies necessary for the proper operation of the device. The
 8   department shall accept the bid of the lowest responsible bidder
 9   and permit any school entity or nonpublic school to purchase the
10   devices at the contract bid price. The department may purchase
11   automatic external defibrillators from any funds appropriated
12   pursuant to subsection (k) for distribution to school entities
13   and nonpublic schools.
14      (c)   To be eligible to obtain or purchase automatic external
15   defibrillators under the program a school entity or nonpublic
16   school must:
17      (1)   Assure that two (2) or more persons assigned to the
18   location where the automatic external defibrillator will be
19   primarily housed are trained as required in subsection (d).
20      (2)   Ensure that the device will be secured in a safe and
21   readily accessible location and agree to properly maintain and
22   test the device according to the manufacturer's operational
23   guidelines.
24      (3)   Submit a valid prescription for the device from a
25   licensed medical practitioner in this Commonwealth.
26      (4)   Agree to provide the training required by subsection
27   (d).
28      (d)   School personnel who are expected to use the automatic
29   external defibrillator shall complete training in
30   cardiopulmonary resuscitation and in the use of an automatic

 1   external defibrillator provided by the American Heart
 2   Association, the American Red Cross or through an equivalent
 3   course of instruction approved by the Department of Health.
 4      (e)   A school entity may include the training required by
 5   subsection (d) in its continuing professional education plan
 6   submitted to the department under section 1205.1.
 7      (f)   The provisions of 42 Pa.C.S. § 8331.2 (relating to good
 8   Samaritan civil immunity for use of automated external
 9   defibrillator) shall apply to school employes who render care
10   with an automatic external defibrillator.
11      (g)   From funds appropriated for this purpose, the department
12   may assist school entities and nonpublic schools that are not
13   equipped with automatic external defibrillators by providing a
14   discount from the contract bid price obtained under subsection
15   (b) or by providing automatic external defibrillators obtained
16   under subsection (b).
17      (g.1)   The purchase of an automatic external defibrillator
18   shall be considered an allowable use of Pennsylvania
19   Accountability Grants under section 2599.2(b).
20      (g.2)   The purchase of automatic external defibrillators
21   shall be considered an innovative educational program under
22   Article XVII-F of the act of March 4, 1971 (P.L.6, No.2), known
23   as the "Tax Reform Code of 1971."
24      (h)   (Reserved).
25      (i)   Not later than June 30, 2014, and each year thereafter,
26   each school entity shall make a report to the department
27   detailing the number, condition, age and placement of automatic
28   external defibrillators in each school building. After the
29   initial report is made, a school entity may report this
30   information as part of the annual report required by the

 1   Commonwealth under section 2505.1 to receive State reimbursement
 2   for health services.
 3      (i.1)   A nonpublic school that participates in the automatic
 4   external defibrillator program under subsection (b) or (g) shall
 5   be subject to the reporting required under subsection (i).
 6      (i.2)   The department shall annually publish a report on its
 7   publicly accessible Internet website no later than December 31,
 8   2014, and each year thereafter. The report shall contain the
 9   following information:
10      (1)   The total number of automatic external defibrillators by
11   school entity and nonpublic school.
12      (2)   The number of school buildings by school entity and
13   nonpublic school that are equipped with automatic external
14   defibrillators.
15      (3)   The number of school buildings by school entity and
16   nonpublic school that are not equipped with automatic external
17   defibrillators.
18      (j)   The department may adopt guidelines as necessary to
19   administer this section.
20      (k)   The General Assembly may appropriate funds to carry out
21   the provisions of this section.
22      (l)   As used in this section--
23      "Automatic external defibrillator" means a portable device
24   that uses electric shock to restore a stable heart rhythm to an
25   individual in cardiac arrest.
26      "Department" means the Department of Education of the
27   Commonwealth.
28      "Nonpublic school" means a nonprofit school, other than a
29   public school within this Commonwealth, wherein a resident of
30   this Commonwealth may legally fulfill the compulsory school

 1   attendance requirements of this act and which meets the
 2   applicable requirements of Title VI of the Civil Rights Act of
 3   1964 (Public Law 88-352, 78 Stat. 241).
 4      "School building" means a building owned by or under the
 5   control of a school entity or nonpublic school where classes are
 6   taught or extracurricular activities are conducted on a regular
 7   basis.
 8      "School entity" means an area career and technical school, a
 9   charter school, a cyber charter school, an intermediate unit or
10   a school district.
11      "Secretary" means the Secretary of Education of the
12   Commonwealth.]
13      Section 5.    The act is amended by adding sections to read:
14      Section 1423.1.    AED and CPR Instruction and Procedure.--(a)
15   Each school entity and nonpublic school shall make available to
16   it's employes and volunteers instruction in the principles and
17   techniques of cardiopulmonary resuscitation and the use of an
18   automated external defibrillator on school premises at least
19   once every two years. The following apply:
20      (1)    The instruction shall be offered as an option to all
21   school entity employes and volunteers.
22      (2)    The instruction shall be conducted by any of the
23   following:
24      (i)    The American Red Cross.
25      (ii)    The American Heart Association.
26      (iii)     National Safety Council.
27      (iv)    An individual certified to conduct CPR training by the
28   American Red Cross, American Heart Association or other
29   certifying agency approved by the Department of Health.
30      (v)    Another certifying agency approved by the Department of

 1   Health.
 2      (3)     A school entity and nonpublic school may provide the
 3   instruction under this section through the Internet or other
 4   electronic means.
 5      (b)     The following apply to AED locations and training:
 6      (1)     Each school entity and nonpublic school that
 7   participates in interscholastic athletics, as defined in section
 8   1602-A, shall ensure that at each AED location there are
 9   individuals trained and certified in CPR and in the use of an
10   AED by an entity listed under subsection (a)(2).
11      (2)     Training must be completed and certification maintained
12   in the use of an AED in accordance with this section.
13      (3)     Each school entity and nonpublic school that
14   participates in interscholastic athletics shall ensure that the
15   individuals trained in the use of an AED have access to the AED
16   on the premises of the school entity and nonpublic school.
17      (c)     The following apply to continuing education
18   requirements:
19      (1)     A school entity may include the training under this
20   section in the continuing education plan submitted to the
21   department under section 1205.1.
22      (2)     Satisfying the education requirements of this section
23   shall also satisfy the education requirements under section
24   1425(d).
25      (d)     Completion of training under this section, including the
26   testing of skills and knowledge, shall be documented by the
27   signature and title of a representative of the training entity
28   and shall include the date that the training was completed. The
29   documentation shall be retained by the school entity and
30   nonpublic school in the file of the employe or volunteer that

 1   completed the training.
 2      (e)    The department, in consultation with the Department of
 3   Health, shall develop guidelines and materials that will assist
 4   school entities and nonpublic schools in the development of a
 5   cardiac emergency response plan. The department shall make the
 6   guidelines and materials available online.
 7      (f)    The following apply to a cardiac emergency response
 8   plan:
 9      (1)    Each school entity and nonpublic school that
10   participates in interscholastic athletics shall develop or amend
11   an existing cardiac emergency response plan that includes:
12      (i)    Nationally recognized evidence-based core elements or
13   standards.
14      (ii)    An annual review.
15      (iii)     Safety procedures to follow in response to a medical
16   emergency involving cardiac arrest and the use of an AED.
17      (iv)    The placement of AEDs on school premises and athletic
18   fields.
19      (v)    The number of individuals who must receive training.
20      (2)    The cardiac emergency response plan of each school
21   entity shall:
22      (i)    Provide cardiac awareness information to be distributed
23   annually to school entity and nonpublic school employes and
24   those responsible for extracurricular activities, community
25   group activities, summer or other programs using the facilities
26   of the school entity.
27      (ii)    Require conducting annual sudden cardiac arrest drills
28   with or without the participation of students to test the
29   cardiac emergency response plan in response to a sudden cardiac
30   arrest.

 1         (g)   As used in this section, the following words and phrases
 2   shall have the meanings given to them in this subsection unless
 3   the context clearly indicates otherwise:
 4         "CPR" means cardiopulmonary resuscitation.
 5         "Department" means the Department of Education of the
 6   Commonwealth.
 7         "Nonpublic school" means a nonprofit school, other than a
 8   public school within this Commonwealth, at which a resident of
 9   this Commonwealth may legally fulfill the compulsory school
10   attendance requirements of this act and which meets the
11   applicable requirements of Title VI of the Civil Rights Act of
12   1964 (Public Law 88-352, 42 U.S.C. § 2000 et seq.).
13         "School entity" means a school district, charter school,
14   regional charter school, cyber charter school, intermediate unit
15   or area career and technical school.
16         "Volunteer" means an individual who holds an unpaid position
17   with a school entity or nonpublic school as a volunteer for a
18   program, activity or service and is responsible for the welfare
19   of children or has direct volunteer contact.
20         Section 1423.2.   Automated External Defibrillator Program.--
21   (a)    The department shall establish the Automated External
22   Defibrillator Program to assist school entities and nonpublic
23   schools in making AEDs available in school buildings.
24         (b)   On a biennial basis, the department, in consultation
25   with the Department of General Services and the Department of
26   Health, shall issue an invitation to bid for the cost of AEDs
27   and other equipment and supplies necessary for the proper
28   operation of the device. The department shall accept the bid of
29   the lowest responsible bidder and permit any school entity or
30   nonpublic school to purchase the devices at the contract bid

 1   price. The department may provide AEDs from any money made
 2   available under section 1306-B(h)(4) and (13) for distribution
 3   to school entities and may loan the AEDs free of charge to
 4   nonpublic schools.
 5      (c)   To be eligible to obtain, purchase or loan AEDs under
 6   the program, a school entity or nonpublic school must:
 7      (1)   Comply with the provisions in section 1423.1.
 8      (2)   Ensure that the AED will be secured in a safe and
 9   readily accessible location and agree to properly maintain and
10   test the device according to the manufacturer's operational
11   guidelines.
12      (d)   The provisions of 42 Pa.C.S. § 8331.2 (relating to good
13   Samaritan civil immunity for use of automated external
14   defibrillator) shall apply to school entity and nonpublic school
15   employes who render care with an AED.
16      (e)   From money made available for this purpose under section
17   1306-B(h)(4) and (13), the department may assist school entities
18   and nonpublic schools that are not equipped with the necessary
19   number of AEDs by providing a discount from the contract bid
20   price obtained under subsection (b) or by providing or loaning
21   AEDs under subsection (b).
22      (f)   The purchase of an AED shall be considered an allowable
23   use of Pennsylvania Accountability Grants under section
24   2599.2(b).
25      (g)   The purchase of AEDs shall be considered an innovative
26   educational program under Article XX-B.
27      (h)   The purchase of AEDs shall be considered an eligible
28   school safety and security expense in section 1306-B(j).
29      (i)   The department may accept donations, including donations
30   of equipment, for use in providing cardiopulmonary resuscitation

 1   and AED instruction to students, employes and volunteers at
 2   school entities and nonpublic schools. The following apply:
 3      (1)    The department shall geographically distribute any
 4   donations to school entities and nonpublic schools for the
 5   purpose of CPR and AED instruction under section 1423.1.
 6      (2)    A school entity or nonpublic school may accept from the
 7   department donations received under this subsection for use in
 8   providing instruction to students, school employes and
 9   volunteers in the principles and techniques of CPR and operating
10   an AED. A school entity or nonpublic school may accept other
11   donations, including donations of equipment, for use in
12   providing the instruction.
13      (3)    To the extent that resources are available to a school
14   entity or nonpublic school under this section, the school entity
15   or nonpublic school may make available instruction to students
16   in the principles and techniques of CPR and operating an AED.
17      (4)    A school entity or nonpublic school may use resources
18   other than those made available under this section to make
19   available instruction to students, school employes and
20   volunteers in the principles and techniques of CPR and operating
21   an AED.
22      (j)    The following apply to reports:
23      (1)    Not later than June 30, 2026, and each year thereafter,
24   each school entity and nonpublic school shall make a report to
25   the department detailing the number, condition, age, expiration
26   date and placement of AEDs in each school building of the school
27   entity or nonpublic school.
28      (2)    The department shall annually publish a report on its
29   publicly accessible Internet website no later than June 30,
30   2026, and each year thereafter. The report shall contain the

 1   following information:
 2      (i)    The total number of AEDs by school entity and nonpublic
 3   school.
 4      (ii)    The number of school buildings by school entity and
 5   nonpublic school that are equipped and not equipped with AEDs.
 6      (iii)   The number of athletic staff by school entity and
 7   nonpublic school that are equipped and not equipped with AEDs.
 8      (k)    The department may adopt guidelines as necessary to
 9   administer this section.
10      (l)    As used in this section, the following words and phrases
11   shall have the meanings given to them in this subsection unless
12   the context clearly indicates otherwise:
13      "CPR" means cardiopulmonary resuscitation.
14      "Department" means the Department of Education of the
15   Commonwealth.
16      "Nonpublic school" means as defined in section 1423.1.
17      "Program" means the Automated External Defibrillator Program
18   established under this section.
19      "School building" means a building owned by or under the
20   control of a school entity or nonpublic school where classes are
21   taught or extracurricular activities are conducted on a regular
22   basis.
23      "School entity" means as defined in section 1423.1.
24      Section 1423.3.   Availability and Specifications of Automated
25   External Defibrillators.--(a)     Each school entity and nonpublic
26   school that participates in interscholastic athletics, as
27   defined in section 1602-A, shall have an automated external
28   defibrillator situated in such a manner that is readily
29   accessible for students participating in interscholastic
30   athletics and practices.

 1      (b)   Nothing in this section shall be construed as
 2   establishing any liability for or a cause of action against a
 3   school entity or nonpublic school or its officers or employes.
 4      (c)   The provisions of 42 Pa.C.S. § 8331.2 (relating to good
 5   Samaritan civil immunity for use of automated external
 6   defibrillator) shall apply to school entity or nonpublic school
 7   employes who render care with an AED.
 8      (d)   Each school entity or nonpublic school shall ensure that
 9   each AED is properly tested and maintained in accordance with
10   the manufacturer's operational guidelines. Each AED in a school
11   entity or nonpublic school shall meet the most recent minimum
12   specifications as required by the Department of Health.
13      (e)   As used in this section, the following words and phrases
14   shall have the meanings given to them in this subsection unless
15   the context clearly indicates otherwise:
16      "Nonpublic school" means as defined in section 1423.1.
17      "School entity" means as defined in section 1423.1.
18      Section 6.   School entities and nonpublic schools shall
19   comply, as applicable, with the addition of sections 1423.1 and
20   1423.3 of the act no later than five years after the effective
21   date of this section.
22      Section 7.   This act shall take effect immediately.
