                                    AN ACT
 1   Authorizing the release of Project 70 restrictions on certain
 2      lands owned by the Pennsylvania Turnpike Commission, formerly
 3      owned by the Borough of West Mifflin, Allegheny County, in
 4      exchange for the imposition of Project 70 restrictions on
 5      other land owned by the Borough of West Mifflin.
 6      The General Assembly of the Commonwealth of Pennsylvania
 7   hereby enacts as follows:
 8   Section 1.   Release of Project 70 restrictions on certain lands
 9                and imposition of Project 70 restrictions on other
10                land.
11      (a)   Authorization.--In accordance with the requirements of
12   section 20(b) of the act of June 22, 1964 (Sp.Sess. 1, P.L.131,
13   No.8), known as the Project 70 Land Acquisition and Borrowing
14   Act, the General Assembly authorizes the release of Project 70
15   restrictions on land owned by the Pennsylvania Turnpike
16   Commission, and formerly owned by the Borough of West Mifflin,
17   Allegheny County, which is more particularly described in
18   subsection (b), in exchange for the imposition of Project 70
19   restrictions on land, which is more particularly described in
20   subsection (c).
 1      (b)     Lands to be released from Project 70 restrictions.--The
 2   lands to be released from Project 70 restrictions are as
 3   follows:
 4      TRACT 1:
 5      ALL THOSE CERTAIN tracts or parcels of land situated in the
 6   Borough of Dravosburg and the Borough of West Mifflin, County of
 7   Allegheny, Commonwealth of Pennsylvania, being bound and
 8   described according to the Pennsylvania Turnpike Commission Plan
 9   No. R/W 14S353, WBS No. M-052.50X002-4-02-98-60, dated June 28,
10   2023, and as follows to wit:
11      FIRST:
12      BEGINNING at a point on the line dividing lands now or
13   formerly of the Borough of West Mifflin and lands of the
14   Pennsylvania Turnpike Commission, formerly Blanche S. Paul, said
15   point being located 614 feet, more or less, right of and
16   opposite SR 0043 Survey and Right-of-Way Baseline Station
17   1899+28±;
18      1.    Thence along said dividing line, and continuing along the
19   line dividing lands now or formerly of the Borough of West
20   Mifflin and lands of the Pennsylvania Turnpike Commission,
21   formerly Union Realty Company of Washington, the following eight
22   (8) courses and distances:
23      a.    North 65º 33' 49" West, a distance of 69.69 feet to a
24   point being located 556 feet, more or less, right of and

23   wit:

11   Pennsylvania being known as Lot 1 of the West Mifflin School
12   District Plan of Consolidation and Subdivision, prepared by
13   Civil & Environmental Consultants, Inc. as Project Mo. 195-
14   450.SV01, dated December 2019, revised February 25, 2020 and
15   recorded in Plan Book Volume 307, Page 83 in the Allegheny
16   County Department of Real Estate, more particularly bounded and
17   described as follows:
18      BEGINNING at a point on the dividing line of Lot 1 and Lot 2
19   in said plan, said point being on the easterly Right-of-Way line

 6   dated April 16, 2021 and recorded April 22, 2021 in the
 7   Department of Real Estate in and for Allegheny County,
 8   Pennsylvania in Deed Book Volume 18407, Page 382, granted and
 9   conveyed unto the Pennsylvania Turnpike Commission.
10      ALSO, BEING the same premises which the School District of
11   Borough of West Mifflin, n/k/a West Mifflin Area School District
12   by Corrective Deed dated June 11, 2021 and recorded June 29,
13   2021 in the Department of Real Estate in and for Allegheny
14   County, Pennsylvania in Deed Book Volume 18492, Page 501,
15   granted and conveyed unto the Pennsylvania Turnpike Commission.
16      (d)    Deed clause.--Project 70 restrictions shall be imposed
17   on the land described in subsection (c) by the following deed
18   clause:
19      This Indenture is given to provide land for recreation,
20   conservation and historical purpose, as said purposes are
21   defined in the "Project 70 Land Acquisition and Borrowing Act"
22   approved June 22, 1954, P.L. 131.
23      (e)    Conditions.--The conveyances described in this section
24   shall be subject to all lawful and enforceable easements,
25   servitudes and rights of others, including, but not confined to,
26   streets, roadways and rights of any telephone, telegraph, water,
27   electric, gas or pipeline company, as well as under and subject
28   to any lawful and enforceable estates or tenancies vested in
29   third persons appearing of record, for any portion of the land
30   or improvements erected thereon.

1   Section 2.   Effective date.
2      This act shall take effect immediately.
